Handling Retaliation Cases: The Cutting Edge
Massachusetts
leading employment lawyers helped practitioners learn about some of the
cutting edge issues in the growing area of retaliation claims. After the
seminar, attendees walked away with an understanding of the current state
of the law, how various state and federal laws differ, differences in
claims under various statutory schemes, how to establish the claim, and
what defenses are effective. Panelists also discussed how in-house counsel
view these claims and what preventive measures are effective and practical
from an organizational standpoint.

tactics from leading in-house counsel, compliance and regulatory officers,
and expert attorneys who represent the drug and medical device industries.

Civil False Claims Act and Qui Tam Enforcement
Bob Thomas and other subject-matter-experts spoke in the opening panel,
titled "Investigation of a False Claims Act Case:" In
every FCA case, the government investigation is crucial because many are
settled before any formal government action is started. This panel discussed
the various issues involved in this pre-filing government investigation,
including issues of privilege, confidentiality, discovery and presentations
by relator, the government and defense. The panel also discussed corporate
disclosure obligations during this period.
